Energy Drinks

While energy drinks are perceived to boost stamina, enhance memory and improve recovery, its prominence among the young generation, employees as well as the health-conscious individuals has boosted consumption. Across the globe, the market value of energy drinks reached USD53.01 billion in 2018 and is projected to increase to USD86.01 billion by 2026 at a compound annual growth rate of 7.20%. In the UAE, a study showed that around 85% of Emirati university students had energy drinks and more than 16% consumed it at least once a day. The UAE government’s Emirates Authority for Standardization and Metrology (ESMA) has put in place relevant regulations and standards to ensure the quality of energy drinks.

Non-alcoholic formulated caffeinated beverages should comply with the following scheme or certification:

EMIRATES CONFORMITY ASSESSMENT SCHEME (ECAS)

  • 1 year validity – a product certification scheme for government-regulated products as mandated by the Federal Law 28 of 2001

 

INDUSTRIAL MEASUREMENT SYSTEM (IMS)

  • 1 year validity
  • follows quality procedures that ensure the calibration and adjustment of measuring instruments in all stages of production

The following are the requirements for ECAS:

  • Valid UAE industry/trade license
  • Registration certificate for IMS (if available, otherwise provide declaration for getting IMS within 6 months)
  • Completed application form via https://eservices.esma.gov.ae/#/page/login (select Notification Body: Prime Certification & Inspection)
  • Test report from accredited and recognized laboratory as per the technical requirements mentioned under UAE.S GSO 1926:2009. Validity of test report should only be 1 year

 

      DECLARATION:

  • Declaration of conformity with standard UAE.S GSO 1926 – Energy Drinks by the applicant on the product(s) for registration using the applicant’s official letterhead
  • Declaration of safe daily intake
  • Electronic declaration of conformity
  • List of used additives with percentage of each additive
  • Health certificate documented and approved by the competent authorities in the country of origin to prove that the product is fit for human consumption
  • Distributor ownership (for traders only)
  • Certificate of origin
  • Halal certificate from approved body by UAE (must be authenticated from Ministry of Environment)
  • Document shows that the factory has an effective FSMS. Controlled copy of relevant (FSMS) manual (soft copy/in CD/DVD)
  • Fulfill the requirements of the card label, warning label and affixed labels mentioned under annex (6) in the gulf standard UAE.S GSO 1926: 2009
  • Finish product label
  • Specification documents for ingredients, packing materials, process aids and final product
  • Copy of current/expired product certification certificate/document (if available)

 

The following are the requirements for IMS:

  • Application form (online)
  • Valid UAE industry/trade license
  • Identifying all legal requirements for each measurement guide, its accessories and supportive devices through technical regulations and instructions prepared for that purpose
  • Declaration of compliance by the applicant
  • Industry layout & design
  • Industrial measurement guidelines manual
  • Responsibilities of all the personnel appointed to manage and apply IMS
  • Mechanisms of importing measurements devices and how to verify their validity as per UAE regulations & requirements of international metrology bodies
  • List of equipment & measuring devices by indicating their use internally/externally
  • Equipment and measuring devices manuals
  • Calibration status of equipment & measuring devices and their calibration certificates with the relevant traceability to international standards
  • Procedures for handling, storage and usage of the equipment and measuring devices
  • Deviation records for measuring devices or other equipment
  • Procedure for preventive maintenance and records for preventive & corrective maintenance of equipment and measuring devices
  • Performance record of equipment & measuring devices
  • Mechanism for control of non-conformity & corrective actions
  • Mechanism for review of measurements management system & continual improvements
  • Mechanism for control of document & record

 

If my factory is outside the country, can I still apply for the ECAS certification?

Yes, you can apply for ECAS certification even if the factory is outside the country through your authorized distributor or trader which is registered in the UAE.

 

What is the scope of UAE regulations for energy drinks?

The Board of Directors Decision No. 19 for the year 2011 is concerned with the general requirements that must be met when recording and trading non-alcoholic energy drinks and does not include athletes’ drinks.
